Terms of Service
The agreement that applies when you use the StaffTiming website and service.
1. About these terms
These Terms of Service (“Terms”) are an agreement between StaffTiming (“we”, “us”) and the business or person using the StaffTiming website or service (“you”, “Customer”). By creating an account, starting a trial or using the service you accept these Terms. If you accept them for a company, you confirm you are authorised to bind it.
StaffTiming is a business tool. If you use it as a consumer, any rights you have under consumer protection law that cannot be excluded still apply.
2. The service
StaffTiming provides time tracking, attendance, timesheets, task management, reporting, payroll and invoicing exports and, where you switch them on, optional monitoring features such as screenshots, activity levels, screen views and location at clock-in. Features differ by plan and may change as we improve the service. We will not remove a core feature of a paid plan during a paid billing period without telling you first.
3. Accounts and free trials
- You must give accurate account information and keep your login details secure. You are responsible for activity under your account.
- You may add users (your employees or contractors). You are responsible for their use of the service.
- Free trials last for the period shown when you sign up (currently 14 days). We may change or end trial offers at any time; a trial already started will not be shortened without notice.
4. Plans, fees and payment
- Fees are charged per user per billing period at the prices shown on our pricing page or in your order, plus any taxes that apply.
- Upgrades and downgrades are pro-rated as described on the pricing page.
- If a payment fails, we may suspend the account after giving notice until it is paid.
- We may change prices for future billing periods by giving at least 30 days’ notice. If you do not agree, you can cancel before the new price applies.
5. Cancellation and refunds
You can cancel at any time. Cancellation takes effect at the end of the current billing period, and you keep access until then. Fees already paid are not refundable except where required by law or where we say otherwise in writing.
6. Your responsibilities when tracking staff
Employment, privacy and monitoring laws differ between countries and states. Because you choose how StaffTiming is used, you are responsible for using it lawfully. In particular you agree to:
- Tell your staff, clearly and in advance, what is tracked, when and why, and get their consent where the law requires it.
- Have a lawful basis for every feature you enable, and enable monitoring features only where they are necessary and proportionate.
- Not use the service to monitor anyone covertly, outside their working time, or on personal devices or accounts without a lawful basis and their knowledge.
- Use the data for legitimate employment and business purposes only, and keep it no longer than needed.
- Answer your staff’s requests to access or correct their data.
We provide the tools; we do not decide how you use them and we do not give legal advice. Information on our website about laws is general information only.
7. Acceptable use
You must not:
- Break any law, or infringe anyone’s privacy, intellectual property or other rights.
- Upload malware, try to break or test the security of the service without our written permission, or disrupt it.
- Copy, resell, reverse engineer or build a competing product from the service, except where the law allows it.
- Use the service to harass, discriminate against or unlawfully monitor any person.
We may suspend access that breaks these rules, and will tell you why unless the law prevents it.
8. Your data
- You own the data you and your users put into the service (“Customer Data”). You give us permission to host and process it only to provide and support the service for you.
- We handle Customer Data as described in our Privacy Policy. We act as your processor; a data processing agreement is available on request.
- You can export your data at any time while your account is active.
- After your account ends we keep Customer Data for 30 days so you can reactivate, and then delete it, unless the law requires us to keep it longer.
9. Our intellectual property
The StaffTiming software, website, text, design, logo and name belong to us or our licensors and are protected by copyright and trademark law. These Terms give you a right to use the service while your subscription is active; they do not transfer ownership. If you send us feedback, we may use it without any obligation to you.
10. Third-party services
The service can connect to third-party products such as accounting, chat and project management tools. Your use of those products is governed by their own terms, and we are not responsible for them. Product names are trademarks of their owners and are used only to describe compatibility.
11. Free tools and website content
Our free calculators, articles and guides are provided for general information only. They are not legal, tax, payroll or financial advice, and results are estimates. Check figures against the rules that apply to you before relying on them.
12. Availability and support
We work to keep the service available and to fix problems quickly, but we do not promise that it will be uninterrupted or error-free, and planned maintenance may happen. Any service level commitment applies only if it is set out in a signed agreement with you.
13. Disclaimer
Except as expressly stated in these Terms, and to the extent the law allows, the service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement.
14. Limitation of liability
To the extent the law allows: (a) neither party is liable for indirect, incidental, special or consequential losses, or for loss of profits, revenue or data; and (b) each party’s total liability under these Terms is limited to the fees you paid us in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law, such as for fraud.
15. Indemnity
You agree to defend and compensate us against claims by third parties, including your staff or authorities, arising from your use of the service in breach of these Terms or of the law, including unlawful monitoring or processing of personal data.
16. Suspension and termination
Either party may end these Terms if the other seriously breaches them and does not fix the breach within 30 days of notice. We may suspend or end access immediately where needed to prevent harm, comply with the law, or stop serious misuse. Sections that by their nature should continue after termination (such as fees owed, data, liability and governing law) continue to apply.
17. Changes to these terms
We may update these Terms. The date at the top shows when they last changed. For significant changes we will give customers at least 30 days’ notice by email or in the service. Continuing to use the service after the change takes effect means you accept the new Terms.
18. Governing law and disputes
These Terms are governed by the laws of Pakistan, and the courts of Pakistan have jurisdiction over disputes, unless mandatory law where you are based gives you the right to bring a claim locally. Before starting proceedings, both parties agree to try to resolve the dispute in good faith by contacting each other.
19. General
- These Terms, the Privacy Policy and any order or signed agreement are the whole agreement between us about the service. A signed agreement takes priority if there is a conflict.
- If any part of these Terms is found unenforceable, the rest stays in force.
- Not enforcing a right straight away does not mean giving it up.
- Neither party is responsible for delays caused by events outside its reasonable control.
- You may not transfer these Terms without our consent; we may transfer them as part of a reorganisation or sale of our business.
